During the course of construction on the project, the general contractor for certain phases of the airport rehabilitation and expansion contracts terminated the demolition contractor for non-performance. Lovett Silverman was retained by the demolition contractor's surety to investigate the termination, determine potential exposure, and assist with finding a completion contractor. Part of the assignment was a review of contractor documents to determine the remaining available contract funds. Of the numerous issues addressed during the review, several key points of dispute were discovered:

  • The general contractor disputed the original contract scope of work along with the associated pricing.
  • There was a multitude of unprocessed change orders due to the GC being negligent in its contract administration.
  • On-going work was being performed by others due to constant changes in the project schedule, which was exposing the surety even further.

With potential performance costs escalating, Lovett Silverman performed an in-depth evaluated and quantified all of the issues. Based on Lovett Silverman's analysis, the surety was able to determine a course of action for further review. Negotiations commenced and resulted in the general contractor issuing a subcontract directly to the completion contractor which allowed for work to continue without any additional cost escalation.
